BUYER TERMS OF USE

1 INTRODUCTION AND PURPOSE
These Buyer Terms of Use ("Terms") govern the relationship between MyCashBox ("Titan Payment System LTD”, “Titan PS”,” Marketplace”, “Platform" or "We") and users ("Buyers" or "You") who access and use the Platform's services to purchase products or services. By using our services, you acknowledge and agree to these Terms.
2 ACCEPTANCE OF TERMS
2.1 Agreement
By using the Platform, you agree to be bound by these Terms and any additional Terms and conditions provided by the Platform from time to time. If you do not agree to these Terms, please do not use the Platform.
2.2 Eligibility
You must be at least 18 years old and have the legal capacity to enter into a contract to use the Platform's services. By using the Platform, you represent and warrant that you meet these eligibility requirements.
3 USER ACCOUNT
3.1 Registration
In order to use the Platform as a Buyer, you may be required to create a user account. You agree to provide accurate, complete, and current information during the registration process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.2 Verification
We may require you to verify your identity and provide additional information for security and compliance purposes. Failure to provide accurate information or refusal to cooperate with verification may result in the suspension or termination of your account.
4 PRODUCT AND SERVICE PURCHASES
4.1 Product Information
The Platform provides product listings and information provided by sellers. We make reasonable efforts to ensure the accuracy and completeness of the information, but we do not guarantee the availability, quality, or suitability of the products or services listed on the Platform. It is your responsibility to review the product details, including descriptions, pricing, and shipping information, before making a purchase.
4.2 Order Placement
By placing an order through the Platform, you make a binding offer to purchase the selected product or service. The seller has the sole discretion to accept or reject your offer. If your offer is accepted, a contract is formed between you and the seller, and you are obligated to fulfill the purchase according to the agreed terms.
4.3 Payment and Pricing
The Platform facilitates payment transactions between Buyers and sellers. You agree to pay the specified purchase price, including any applicable taxes and fees, using the available payment methods provided on the Platform. We do not guarantee the accuracy or currency of pricing information and reserve the right to correct any pricing errors.
4.4 Order Fulfilment and Delivery
The seller is responsible for fulfilling and delivering the purchased products or services. Any delivery times or estimates provided on the Platform are approximate and subject to change. We are not liable for any delays, damages, or losses arising from the seller's fulfilment or delivery process.
5 USER RESPONSIBILITIES AND CONDUCT
5.1 Compliance
You agree to use the Platform and its services in compliance with all applicable laws, regulations, and these Terms. You will not engage in any fraudulent, unauthorized, or illegal activities in connection with the Platform.
5.2 Communication and Feedback
You agree to communicate respectfully and professionally with sellers and other users on the Platform. You may provide feedback and reviews based on your experience with sellers, but you agree to provide honest and accurate information.
6 REFUNDS AND DISPUTES
6.1 Refund Policy
The refund policy for purchases made through the Platform may vary depending on the seller's policies. It is your responsibility to review the seller's refund policy before making a purchase. We are not responsible for issuing refunds on behalf of sellers.
6.2 Dispute Resolution
In the event of any dispute or claim arising from a purchase, we encourage you to contact the seller directly to resolve the issue. If you are unable to reach a resolution, you may notify us, and we will assist in facilitating communication and dispute resolution. However, we are not responsible for resolving disputes between Buyers and sellers and do not guarantee a satisfactory outcome.
7 INTELLECTUAL PROPERTY
All intellectual property rights in the Platform, including its content, design, and trademarks, are owned by or licensed to us. You agree not to reproduce, modify, distribute, or create derivative works based on the Platform without our prior written consent.
8 LIMITATION OF LIABILITY
8.1 Disclaimer
We provide the Platform and its services on an "as is" and "as available" basis. We do not guarantee continuous, uninterrupted, or error-free access to the Platform and make no warranties regarding the accuracy, reliability, or completeness of any information or content provided.
8.2 Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your breach of these Terms, or any violation of applicable laws or regulations.
9 GOVERNING LAW AND DISPUTE RESOLUTION
9.1 Governing Law
These Terms shall be governed by and construed in accordance with the Laws of Ghana. Any legal action or proceeding arising out of or relating to these Terms shall be exclusively brought in the courts of Ghana.
9.2 Dispute Resolution
In the event of any dispute or claim arising under these Terms, the parties shall attempt to resolve the dispute through good-faith negotiations within 30 days of the dispute being reported. If the parties are unable to reach a resolution, the dispute shall be submitted to binding arbitration in accordance with the rules of Alternative Dispute Resolution Act, 2010 (Act 798).
10 GENERAL PROVISIONS
10.1 Entire Agreement
These Terms constitute the entire agreement between you and us concerning the subject matter herein and supersede all prior or contemporaneous communications and proposals.
10.2 Updates
We may update this Buyer Terms of Use from time to time to reflect changes in our practices or legal requirements. We will notify you of any material changes by posting the revised Buyer Terms of Use on our Platform or by other means as required by law. Logging in after such updates will require you to accept the revised Buyer Terms of Use.
10.3 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
